I believe it is important that all New Zealanders – including farmers – understand their legal rights, the limits of council authority, and the proper role of iwi consultation under the law.\n\nMy wish is simply to ensure that local government operates openly, lawfully, and in a way that respects everyone’s rights. UNLAWFUL (ULTRA VIRES) COUNCIL PRACTICES TO WATCH FOR**\n\nThese practices are not authorized by law and can be challenged:\n\n1. Mandatory Cultural Impact Assessments (CIAs)\n\nCIAs are not legally required.\n\nCouncils cannot force farmers to obtain one or pay iwi for one.\n\n2. Iwi veto or approval requirements\n\n**If a council says ‘iwi must approve this’, that is unlawful.**\n\n3. PROTECTION FOR COUNCILLORS: DECLARATION OF NON‑INTIMIDATION**\n\nCouncillors should adopt a formal declaration stating they are:\n\n• acting independently\n\n• free from intimidation\n\n• not delegating authority to iwi\n\n• not pressured by the mayor/chair/CEO\n\n• not treating iwi as co‑governors\n\nThis protects:\n\n• councillors\n\n• farmers\n\n• the integrity of the decision‑making process\n\n**6. WHAT FARMERS CAN SAY TO COUNCIL – AND BE LEGALLY CORRECT**\n\nHere are lawful statements farmers can use:\n\n‘Please provide the exact statutory authority for this requirement.’\n\nIf they cannot, the requirement is unlawful.\n\n‘Iwi cannot require permits or approvals on my private land.’\n\nThis is legally correct.\n\n‘Cultural Impact Assessments are not mandatory under the RMA.’\n\nCorrect.\n\n‘I am not required to pay iwi for consultation.’\n\nCorrect.\n\n‘Council cannot delegate decision‑making to iwi.’\n\nCorrect.\n\n‘Iwi management plans must be taken into account, not followed.’\n\nCorrect.\n\n**7. WHAT COUNCIL LEADERS MUST NOW PUBLICLY CONFIRM**\n\nThe mayor, chair, and CEO must state – clearly and on record – that:\n\n1. Iwi have no regulatory authority over private land.\n\n2. Iwi cannot require permits, approvals, or fees.\n\n3. Iwi cannot impose conditions on consents.\n\n4. Councillors must not be pressured to treat iwi as co‑governors.\n\n5. All decision‑making authority remains with elected members and authorized council officers.\n\nIf they refuse, they are acknowledging that unlawful practices are occurring.\n\n**8.
