A charging protocol generating apparatus according to an embodiment of the present disclosure includes a profile obtaining unit configured to obtain a charging profile of a battery charged by repeating a charging period and a rest period at a preset charging C-RATE; and a control unit configured to generate a resistance profile representing a corresponding relationship between a resistance of the plurality of rest periods and SOC (State of Charge), determine a maximum allowable SOC corresponding to the charging C-RATE based on a resistance pattern of a target SOC section of the generated resistance profile, and generate a charging protocol including a corresponding relationship between the charging C-RATE and the maximum allowable SOC.
