ISLAMABAD: Proceedings in the One Constitution Avenue case at the Islamabad High Court (IHC) could not be held on Wednesday due to the unavailability of the division bench, resulting in the cancellation of the day’s cause list. A two-member bench comprising Justice Muhammad Azam Khan and Justice Inam Amin Minhas was scheduled to hear multiple intra-court appeals, including applications seeking to include new sub-lease holders of apartments originally linked to the PTI founder in the litigation. The case pertains to sub-lease holders of One Constitution Avenue who have secured stay orders from the court against their eviction. The interim protection preventing their removal was automatically extended until the next hearing due to the adjournment. Petitioners, including Shahid Naseer, who holds a sub-lease for an apartment in Tower C originally associated with the PTI founder, Imran Khan and daughter of senior lawyer Aitzaz Ahsan, Zainab Ahsan have filed applications seeking to become parties in the ongoing intra-court appeals. They have requested that five sub-lease holders be formally included as appellants, arguing that they lawfully acquired their apartments and are directly affected by the proceedings. The federal government has also constituted a committee headed by Law Minister Azam Nazeer Tarar to review the matter. According to court records, the Capital Development Authority (CDA) had earlier cancelled the lease granted for the project, a decision later upheld in principle by the IHC's Chief Justice Sardar Sarfraz Dogar, who ruled the cancellation lawful. The sub-lease holders continue to seek legal protection, arguing that their property rights must be safeguarded as the litigation proceeds.
