There was obvious legal pressure put on OpenTTD, otherwise we'd have heard something aside from the corpo-clean-says-actually-nothing-FAQ. The threat of lawsuits and whatnot is of course enough to get Atari what it wants; it's not like anyone likes the idea of financial risk of going to court over a hobby project.
