Can't hit the crouching lawyer with the stun stick

So I'm trying to do the dr dre heist, and I'm in the mission to kidnap the lawyer. However, he's crouching, cowering, and I can't HIT HIM with the stun stick they gave me. Every time I try to attack, it either steps PAST him, or swings over him. Any help? Tries tear gas, thinking he might stand up, but it just failed the mission instead.
